Recently in Corpus Christi, a new city law passed that imposes a $500 fine if the police spot a driver using a cell phone. According to a study done by the University of California Berkeley, a California law making hands-free use mandatory that went into effect in 2008 was related to a 20% reduction in fatalities and collisions from the average of the previous 3-5 years. However, a study released this past June from the American Auto Association’s Foundation for Highway Safety found that hands-free systems are more distracting than hand held phones.

These hands-free systems supposedly create a significant cognitive distraction. The study states that the brain is so engaged in interacting with the system that despite having hands on the wheel and eyes on the road, reaction time is delayed up to 1/5th of a second. With over nine million hands-free system equipped vehicles on the road, if this conclusion is bears out, it may be that the current solution is worse than the problem.

Whether new laws like the one in Corpus Christi will result in a reduction in car accidents and fatalities time will tell. However, for now distracted driving is still a major source of today’s car accident cases seen by our attorneys.

Motor vehicle accidents are still a primary cause of death for teens behind the wheel. Texas is still among the highest in teen driving fatalities, with only three states in the nation reporting more.
