In an ideal world, people would get settlements within a matter of days after being in a car accident that caused serious injuries or significant damages. In a less-than-ideal world, it would only take a few weeks at most. In the real world, the circumstances of your accident or incident could mean you might not receive any compensation for months or more.
Three reasons your case settlement could be delayed are:
- Issues: If you were rear-ended at a red light, it should be pretty clear who is to blame for the accident. But in most situations, liability is not necessarily obvious; you may know that you aren’t liable but insurance companies don’t know it. Imagine the scenario where you slipped and fell in someone’s home – something as simple as that could cause big complications, which cause noticeable delays.
- High costs: The more money it will require to recover from your accident, the longer your case is going to take. Insurance providers or individual plaintiffs are hesitant to hand out a couple thousand dollars so their reluctance is magnified for tens of thousands of dollars or more. You can bet they will exercise the full extent of their right to due diligence, or their ability to investigate a claim, and leave no stone unturned, pushing your settlement back to a future date.
- No MMI: Until you have reached maximum medical improvement (MMI), meaning no amount of hospital care, medicine, and surgery will heal your injuries further, you don’t know how much your full recovery is going to cost. Unless you are comfortable with estimating and seeking an amount of compensation that realistically will be too small, you need to wait for a doctor to declare you’ve reached MMI and then tally up your medical bills to list in your claim.
In the big picture, it is almost-always to the plaintiff’s advantage to wait patiently for a settlement, either negotiated higher with a lawyer’s help or won through courtroom litigation. If you absolutely cannot put compensation off any longer, talk to your attorney about what you can expect if you were to offer to settle right now. Just don’t be surprised if it is a fraction of what you deserve.
